WISHA overview
Washington's Worker's and Occupational Safety and Health Act (WISHA) is enforced by the Department of Labor and Industries (L&I). Washington has a fully comprehensive State Plan covering all private and public sector employers — federal OSHA has no jurisdiction over Washington workplaces.
Standards at least as strict as federal
WISHA standards must be at least as effective as federal OSHA standards. Washington has adopted federal OSHA standards with modifications and has created additional Washington-specific rules in several areas.
Outdoor heat rule (WAC 296-62-095)
Washington was one of the first states to adopt a comprehensive outdoor heat illness prevention rule. Employers must provide drinking water, rest breaks, shade, and training when outdoor temperatures reach 89°F. The rule also covers indoor work environments with heat exposure.
Fall protection
Washington's fall protection rules (WAC 296-155-245) are similar to federal OSHA but include additional requirements for some specific situations. Washington has been particularly active in fall protection enforcement in construction.
Reporting requirements
All work-related fatalities must be reported to L&I within 8 hours. Hospitalizations, amputations, and loss of an eye must be reported within 24 hours — the same as federal OSHA.
Consultation services
Washington's WISHA Services Division offers free consultation services to employers — similar to federal OSHA's On-Site Consultation Program. These are confidential and separate from enforcement.
